5 Documents Every Adult Over 60 Needs Right Now

A health crisis can happen without warning. When it does, your family needs legal authority to act on your behalf — and without the right documents, even a spouse can be turned away. Here are the five documents every adult over 60 should have in place.

1. Last Will & Testament

Directs who receives your assets, names an executor, and — for parents — designates a guardian for minor children. If yours is more than five years old, it likely needs updating. Without a valid will, Tennessee’s intestate laws decide for you.

2. Durable Power of Attorney (Financial)

Gives a trusted person legal authority to manage your finances if you’re incapacitated. The word “durable” is critical — a standard POA becomes void the moment you can’t act for yourself. Without it, your family may need a costly court proceeding just to pay your bills.

3. Advance Healthcare Directive (Living Will)

Documents your medical wishes in writing — resuscitation, life support, comfort care — so your family isn’t left making impossible decisions in a crisis. Tennessee has specific legal requirements; a generic online form may not be valid here.

4. Healthcare Power of Attorney

Names a specific person to make medical decisions on your behalf when you can’t. This works alongside your directive — the directive states your wishes, your agent enforces them and fills in the gaps. Even a spouse doesn’t automatically have this authority without a formal document.

5. Beneficiary Designations Review

Not a document you create — but the most overlooked item on this list. Beneficiary designations on retirement accounts, life insurance, and bank accounts override your will entirely. An outdated form naming an ex-spouse or a deceased person can undo everything else you’ve planned.

These five documents work as a system. Having four out of five still leaves gaps — and the window to put them in place is while you’re healthy. Once cognitive decline begins, certain documents can no longer be legally executed.
